Grandparents’ Rights Attorney in Charlotte

Evaluating Grandparents' Legal Options Under North Carolina’s Custody & Visitation Statutes

North Carolina doesn’t grant grandparents automatic visitation rights. The law provides specific pathways, and whether you qualify depends entirely on your family’s circumstances. At Law Office of Kelli Y. Allen, PLLC, we help Charlotte-area grandparents determine which statutory pathway applies to their situation and what pursuing it realistically involves.

If you’re concerned about losing contact with a grandchild, call us at (704) 870-0340 to schedule a confidential consultation. We can review the facts of your situation and give you a clear picture of your options.

When North Carolina Courts Can Award Grandparent Visitation

Grandparent visitation isn’t available on request.

North Carolina allows grandparents to seek visitation when:

The Substantial Relationship Requirement

Even within those circumstances, the grandparent must demonstrate a substantial relationship with the grandchild before visitation becomes available. A substantial relationship generally means a meaningful, ongoing connection, not occasional contact. Once the court finds that threshold met, it applies the best-interests-of-the-child standard to decide whether visitation is appropriate and, if so, how much.

Factors the court may consider include:

  • How frequently the grandparent saw the child
  • Whether the grandparent helped with transportation, meals, daily care, etc.
  • Whether the child and grandparent shared vacations, holidays, or other family routines
  • And other considerations

Procedural Requirements

Two additional procedural requirements matter here:

  • Motion to intervene: To seek visitation in an active custody lawsuit, a grandparent must file a motion to intervene and be accepted as a third party to that proceeding before the court will entertain a visitation request.
  • Modification standard: If a custody order already exists and circumstances have changed, a grandparent seeking to add visitation must show a substantial change in circumstances affecting the child’s welfare. The burden of proving that change rests with the grandparent making the request.

Any visitation the court awards must be structured so it doesn’t adversely interfere with the parent-child relationship. North Carolina’s Court of Appeals has overturned schedules found too broad, which means the scope of any order matters as much as whether one is granted at all.

Grandparent Custody: A Higher Legal Bar

Seeking custody rather than visitation requires clearing a higher legal hurdle. Parents hold a constitutionally protected right to the care and custody of their children, and courts presume that a fit parent acts in the child’s best interests. To overcome that presumption, a grandparent must show that both parents have forfeited their constitutional right through unfitness, neglect, abandonment, or conduct otherwise inconsistent with their parental role.

Unlike the visitation statutes, grandparents pursuing custody don’t need to wait for the parents to initiate a case. They can file an initial custody action or intervene in an existing one once the factual grounds exist.

Common Mistakes to Avoid in Grandparents' Rights Situations

Emotional strain and high-stakes family dynamics can lead grandparents to take steps that may compromise their legal standing or inflame parental opposition.

Avoiding these critical missteps is important:

  • Waiting too long: Filing a motion to intervene after an active parental custody case settles or closes misses the statutory window.
  • Confronting parents aggressively: Sending angry texts, hostile voice messages, or public social media rants provides opposing counsel with direct evidence of conflict.
  • Broadcasting disputes online: Venting case details or disparaging parents publicly demonstrates poor judgment regarding family privacy.
  • Relocating or taking the child out of state: Unilateral travel or keeping a child past agreed timelines triggers emergency recovery or custodial interference orders.
  • Skipping qualified legal counsel: Guessing at third-party standing requirements or missing procedural steps can create many risks.
