Expansion of Statewide Waiver Program

As part of the new immigration plan announced by President Obama, USCIS will be expanding the I-601A, Stateside Provisional Waiver program. Currently, this program benefits spouses and children of U.S. citizens who would experience extreme hardship upon the removal of their relative.

Under the expansion, spouses and LPRs and sons and daughter (of any age) of US citizens or LPRs would be eligible. Additionally, the current standard of "extreme hardship" is to be clarified and expanded. Although no details have been released to date, it is possible that the clarification will make it easier to demonstrate the requisite hardship.
