Adjustment of Status Pre-Registration

Soon, many individuals who are beneficiaries of an approved employment-based immigrant visa petition (I-140) will be eligible to pre-register for adjustment of status.

Currently, most employment-based immigrant visa categories have several year backlogs. This means that although the visa petition has been approved, individuals are not able to actually apply for permanent resident status and begin working while waiting for a visa number to become available.

Under the new program, these individuals will be able to file an I-485, Adjustment of Status application before a visa number is available, thereby gaining the advantages of having a pending application. This will allow these applicants to work legally in the U.S. while waiting for a visa number in their category to become available.
