Soon, many individuals who are beneficiaries of an approved employment-based
immigrant visa petition (I-140) will be eligible to pre-register for adjustment
Currently, most employment-based immigrant visa categories have a several
year backlog. This means that although the visa petition has been approved,
individuals are not able to actually apply for permanent resident status
and begin working while waiting for a visa number to become available.
Under the new program, these individuals will be able to file an I-485,
Adjustment of Status application before a visa number is available, thereby
gaining the advantages of having a pending application. This will allow
these applicants to work legally in the U.S. while waiting for a visa
number in their category to become available.
