Deferred Action Update

USCIS has provided updated information for affirmative deferred action applicants. Although the application form has not yet been released, USCIS will begin accepting these applications on August 15, 2012. The total application fee to the Department of Homeland Security will be $465. This includes the fee for the I-765, Application for Employment Authorization.

Hundreds of thousands of applications are expected, and USCIS has given no indication of expected processing times. Eligible applicants should assemble all required documentation and be prepared to submit applications as soon as possible after August 14th. Extensive documentation is required. You must be able to prove that you meet each of the eligibility requirements, otherwise, your application will be denied. Further, USCIS has announced that there will be no appeal of denied applications, nor will they accept a motion to reopen or reconsider once a discretionary decision has been made. This makes it even more important to retain the services of a reputable immigration attorney to assist with this process. Beware of notarios or other individuals who guarantee results or claim that very little documentation is required. Additionally, when comparing attorney fees for the process, make sure the fee quoted includes the preparation of the employment authorization application.
